5. How and why we use your information
We only process personal information where we have an appropriate lawful basis. Depending on the circumstances, this may include processing because it is necessary to take steps at your request before entering into a contract; it is necessary to perform a contract with you; it is necessary to comply with a legal or regulatory obligation; it is necessary for our legitimate business interests, where those interests are not overridden by your rights and interests; or you have provided consent where consent is the appropriate legal basis.
Responding to enquiries
We use your information to respond to enquiries; provide requested information; arrange meetings; assess whether Tidewater may be able to assist you; and maintain appropriate records of our communications. Our lawful basis will generally be legitimate interests or taking steps at your request before entering into a contract.

We will not sell your personal information to third parties for their own marketing purposes.
6. Investor information and financial promotions
Certain information relating to investment opportunities may be subject to restrictions under UK financial-services legislation. We may therefore need to collect information to establish whether a recipient falls within an appropriate category before providing particular investment information. Providing information to Tidewater does not guarantee that you will qualify to receive information about an investment opportunity, nor does it guarantee that Tidewater will accept an investment from you. Any investment-specific communication may be subject to additional eligibility requirements, warnings, terms and disclosures.
7. Special-category personal information
We do not generally seek to collect special-category personal information, such as information regarding health, ethnicity, religion, political opinions or sexual orientation. Please do not provide this type of information unless it is genuinely relevant and necessary. Where we are required to process special-category information, we will only do so where an appropriate legal basis and additional condition applies.
8. Criminal-offence information
We do not routinely collect criminal-offence information. Where such information is legitimately required as part of legal, regulatory or due-diligence processes, we will process it only where permitted by law.

We require service providers processing information on our behalf to handle personal information appropriately and in accordance with applicable data-protection requirements. We do not sell personal information.
10. International transfers
Some technology or professional service providers may process information outside the United Kingdom. Where personal information is transferred internationally, we will take reasonable steps to ensure that an appropriate legal mechanism or safeguard is in place where required. You may contact us for further information about safeguards applying to relevant transfers.
11. How long we retain information
We do not retain personal information indefinitely. Retention depends on the purpose for which information was collected, legal requirements and the need to establish or defend legal rights. As a general approach: general enquiries that do not progress into a business relationship will normally be retained for up to 24 months after the last substantive contact; investor enquiries and eligibility records may be retained for an appropriate period necessary to evidence communications, classification and compliance; records relating to a contractual, investment, property or commercial relationship will normally be retained for up to six years after the relationship or transaction ends, unless a longer period is required; accounting and tax records will be retained for the period required by applicable law; legal, property-title, corporate or transaction documents may need to be retained for longer where appropriate; marketing information will be retained until you opt out or we determine that continued retention is no longer appropriate; and cookie information will be retained in accordance with our Cookie Policy. We may retain information for longer where litigation, an investigation, contractual obligations or another legitimate reason requires us to do so.
12. Security
We take reasonable technical and organisational measures intended to protect personal information from unauthorised access; accidental loss; misuse; alteration; disclosure; and destruction. Access to personal information is restricted to those who reasonably require access for legitimate business purposes. No internet-based system is completely secure, however, and we cannot guarantee absolute security of information transmitted electronically.
13. Your rights
Depending on the circumstances and the lawful basis on which your information is processed, you may have rights including the right of access; the right to rectification; the right to erasure; the right to restriction; the right to object; the right to data portability; the right to withdraw consent; and rights relating to automated decision-making. These rights are not absolute and exemptions may apply.
You have the right to object at any time to the use of your personal information for direct marketing. If you ask us to stop direct marketing, we will do so.
To exercise your rights, contact office@tidewaterestates.co.uk. We may need to verify your identity before responding.
14. Automated decision-making
Tidewater does not currently make decisions that produce legal or similarly significant effects on individuals solely through automated processing. If this changes, this Privacy Notice will be updated as required.
15. Children
Our website and services are intended for adults and business users. We do not knowingly seek to collect personal information from children.
16. Third-party websites
Our website may contain links to websites operated by third parties. Tidewater is not responsible for the privacy practices of third-party websites. You should review the relevant privacy information provided by those organisations.
17. Complaints
If you have concerns about how we process your personal information, please contact us first so that we can investigate the matter. You also have the right to complain to the UK data-protection regulator, the Information Commissioner’s Office (ICO), at ico.org.uk. You are not required to contact us before approaching the ICO.
